Court Strikes Down Rally Restriction (2014/03/21)
The Constitutional Court ruled Friday on a controversial part of the Assembly and Parade Act. The act bars outdoor rallies from being held without first obtaining permission.
In their ruling, the justices said that this regulation violates the Constitutional right to freedom of assembly. They struck down the requirement to obtain permission, effective from January 1, 2015.
集遊法違憲
司法院大法官今天針對集會遊行法中,關於室外偶發、緊急性集會必須事前申請許可的規定,作出違憲的解釋。
大法官認為這樣的規定違反憲法"保障人民集會自由"的規定。釋憲文將於2015年1月1日生?。不過這次學生佔領立法院屬於室內集會,即便日後走出戶外,恐怕都不適用這次釋憲解釋。
