Labor minister: No appeal in government loan dispute (2014/03/10)

Labor Minister Pan Shih-wei says he will respect a ruling that millions in payments made to laborers affected by a plant closing in 1997 do not need to be repaid. Pan’s decision to not appeal Friday’s ruling, and to end related ongoing lawsuits, brings to an end one of Taiwan’s highest profile labor disputes. 

Labor Minister Pan Shih-wei held a press conference today where he said he would accept a Taipei High Administrative Court ruling that “loans” given to laborers amount to compensation and do not need to be repaid. The court also had ruled that the case exceeded the statute of limitations.

I hope to resolve this issue so the workers affected by the factory closing can alleviate their physical and mental suffering as soon as possible. We respect the ruling and won’t appeal. We will also take the initiative to withdraw lawsuits that are still in progress.

The Ministry of Labor has even decided to pay back the laid off laborers who made good on their loans and completed payment.

In the future, our approach will be to take money from the Employment Stabilization Fund to pay those laborers who have repaid their loans. We estimate the cost will not exceed NT$50 million.

Despite winning this verdict, some laborers continue to feel anger and resentment. They are especially upset that some colleagues died before a final verdict could be reached. Today they demonstrated outside the ministry and urged the labor minister to apologize.

關廠工後續 

1997年，勞委會以「貸款」名義開放受到全台爆發惡性關廠潮的失業工人申請，於2012年開始催討，甚至對部分工人提出告訴。週五被法院判定敗訴之後，勞動部主委潘世偉宣布不再上訴。

在台北高等行政法院認定「貸款」屬於補償，而且也早已過了法律追訴期之後，勞動部主委潘世偉親自召開記者會，放棄上訴。

“希望關廠勞工能夠早日免除，身心煎熬的過程，對於該案的判決我們尊重不再上訴，對於尚在訴訟中的案件，我們會主動撤回訴訟”

另外對之前已經還款的關廠工人，勞動部也有新的做法。

“未來我們的做法是從就業安定基金裡面去支應這筆錢，給已經繳款的勞工，以最大的規模來算的話，應該不超過五千萬”

雖然不用還款，關廠工人對於自己等到正義，卻有許多同事等不到，相當感傷，到勞動部門口要求潘世偉道歉。
